"It is believed based on the investigation to date ... that Cummins, age 50, and VICTIM, age 15, are involved in sexual relationship and traveled in interstate commerce to continue their relationship and to engage in unlawful sexual activity", according to the affidavit.

One resident said the pair told them Thomas was 24 and Cummins was 40 and that they had been married for a year.

The girl cooperated with authorities, Houtman said, and she flew back to Tennessee with the Federal Bureau of Investigation.

Elizabeth left a strained family dynamic of an ongoing domestic case between Elizabeth and her mother. During 38 days on the run, Cummins tried to avoid detection by switching license plates on a 2015 Nissan Rogue he stole from his wife and disabling its GPS system, authorities said.

Cummins is still being held without bail at a Siskiyou County, California, jail while he awaits extradition back to Tennessee.

Both were captured Thursday in northern California.

Federal charges were read against Tad Cummins during his first court appearance in Sacramento Monday, but he did not enter a plea.

The man charged in the kidnapping of a Tennessee girl acknowledged in California federal court that he is the suspect and agreed to return to Tennessee to face charges there.

Siskiyou County deputies formed a perimeter around the 12-by-12-foot cabin for several hours that night before drawing Cummins out the next morning to arrest him.

But instead of going to the beach, police said he picked up the student in Columbia, Tennessee, in his wife's auto on the morning of March 13 and headed west.

Cummins and Elizabeth were found on April 20 at a remote cabin in northern California near the OR border after over a month on the run.

The student who reported the kissing said she confronted Cummins, who was a teacher at the school.

Surveillance images showed them at a Walmart in Oklahoma City on March 15.
